President Shavkat Mirziyoyev got acquainted with the presentation on issues for improving the judicial system and ensuring justice.
In recent years, this area has been undergoing consistent reform: courts have ceased to be punitive bodies and have become a system for protecting human rights. In particular, administrative courts have been established. Effective measures have been taken to prevent domestic violence. A body of judges for family matters has been formed. A separate judicial panel for investment disputes has been established.
These reforms are felt in practice by citizens, and their importance is recognized by foreign experts.
At the same time, many issues remain to be resolved regarding increasing the openness and accessibility of justice, creating conveniences for the population through digitalization, and training highly qualified personnel.
Plans and measures for their implementation were discussed at the presentation.
Taking into account modern requirements, the concept of a “digital court” has been developed based on the experience of developed countries. It is designed to prevent corruption and provide citizens and entrepreneurs with access to fair justice without unnecessary bureaucratic complications.
The analysis demonstrated that a significant portion of the claims considered by civil and economic courts relate to uncontested cases. In this regard, it is proposed to transfer the consideration of such issues to administrative bodies, which will facilitate the rapid resolution of problems faced by citizens and business entities.
Another innovation concerns the consideration of administrative and economic cases on an extraterritorial basis. Modern digital technologies allow for the implementation of such a possibility.
The stability of judicial positions is of particular importance for strengthening the principles of justice and trust in the courts. In this regard, it is envisaged to review the terms of appointment of judges.
It is proposed to create regional review courts for courts of all types and to abolish review instances of regional and equivalent courts. As a result, only appellate and cassation instances will operate in regional and equivalent courts, and the review instance will be concentrated in five regional courts.
Special attention is paid to the fundamental improvement of the training system for the judicial system. In this regard, a concept for reforming the Higher school of judges and organizing an Academy of justice on its basis is presented.
The Head of State approved the proposed initiatives, signed relevant decrees and instructed to ensure a systemic and quality implementation of the tasks.
